Auto Accidents

What Causes Auto Accidents?

The term "auto accidents" suggests that crashes are unlucky occurrences over which drivers have little control. While this is sometimes the case, statistics show that most auto accidents could have been avoided. The four main contributing factors for nearly all auto accidents are driver behavior, equipment failure, negligent roadway maintenance, and faulty roadway design. In the vast majority of auto accidents, driver behavior is the primary factor. Although the other three factors occasionally come into play, aggressive or negligent driving is usually at fault.

Auto Accident Liability

In an auto accident where driver behavior is the primary contributing factor, one of the drivers involved is usually found to be "at fault." Some examples of negligent driver behavior are: inattentiveness, falling asleep at the wheel, and aggressive driving. Inattentiveness can include being preoccupied with other passengers, using a cell phone, changing the car radio station, etc. While falling asleep is not intentional, drivers who stay on the road despite exhaustion are endangering the lives of others. The most frequent cause of auto accidents is aggressive driving. This can include speeding, tailgating, driving under the influence, unsafe maneuvering, failure to yield right of way, and disregard for traffic controls. This sort of reckless driving is against the law, and a driver who causes an auto accident through such actions can be found liable for the damages that result.

Auto Accident Litigation

While some auto accidents are easily handled without involving lawyers, victims who sustain serious injury or death should hire legal representation immediately. It is critical that injured parties retain qualified counsel, because the outcome of the lawsuit could determine the future of all those directly affected. Injured parties may have large medical bills to pay and a loss of earning potential, to say nothing of the pain and suffering incurred. Experienced auto accident lawyers know what evidence to preserve, how to prove liability, how to negotiate with insurance companies, and what compensation is appropriate under the given circumstances.
